There are Presently four types of Land Tenure Systems in Uganda; Customary, Mailo, Freehold and Leasehold.

Leasehold can be defined as holding land for a known time frame based on conditions in an agreement between the registered owner and the tenant. Leasehold tenure involves a landowner giving another person, called a tenant/ lessee, the right to possess or control the land in exchange for payment.

Customary tenure is a form of land holding where land is held and managed according to the generally acceptable norms and practices of a particular community. This type of tenure is believed to constitute approximately 80% of the total land in Uganda.

The basic unit of a Mailo System is a square mile, hence the derivation of Mailo, which is also equivalent of 640 acres. The term is used in Uganda to describe a land tenure system that came into effect when the kingdom of Buganda Signed an agreement with the British-administered Uganda Protectorate there 1900. The Mailo tenure system recognises occupancy by tenants (Locally known as Kibanga holders), whose relationship with their overloads or landlords is governed and guided by the provisions of the land Act. Mailo land is like freehold is like freehold is registered under the Registered of Titles Act.

The 1998 Constitution describes leasehold tenure as one where one party grants to another the right to exclusive possession of land for a specified period, usually in exchange for the payment of rent. Under this type, a landowner (whether through freehold, Mailo, or customary tenure) grants a lease to another person.

In practice, much of the land that is leased was previously owned by government bodies, particularly the Land Commission and the District Land Board, and normally this comes with some development conditions imposed on the land’s subsequent use by those to whom it is leased.
